The legal dispute between Elon Musk and OpenAI is escalating as both parties prepare for trial later this month. OpenAI has accused Musk's recent proposals as constituting a 'legal ambush,' a development initially reported by Bloomberg.

In its Friday response, OpenAI detailed that Musk was 'sandbagging the defendants and injecting chaos into the proceedings, while trying to recast his public narrative about his lawsuit.' The lawsuit, filed by Musk in 2024 against OpenAI and Microsoft, alleges the AI giant abandoned its original non-profit mission to become a for-profit entity after securing financial backing and forming a partnership with Microsoft.

Prior to OpenAI's latest filing, Musk amended his original complaint earlier this month. The revised filing sought to award any received damages to OpenAI's non-profit arm and also aimed to remove Sam Altman from his roles as OpenAI's CEO and board member. OpenAI's Friday filing countered these last-minute changes, labeling them 'legally improper and factually unsupported.'

The stakes in this lawsuit are significant, with Musk reportedly seeking between $79 billion and $134 billion in 'wrongful gains.' Both OpenAI and Microsoft continue to deny any wrongdoing. The trial remains scheduled to commence on April 27.
