Elon Musk Testifies in High-Stakes Trial Against OpenAI, Citing AGI Mission Breach and Fraud Allegations

Elon Musk has officially begun his testimony in the high-profile trial he initiated against OpenAI CEO Sam Altman and company president Greg Brockman.

Musk, Altman, and Brockman were integral members of OpenAI's initial founding team, with Musk providing an early investment of up to $38 million. However, their relationship deteriorated due to disagreements over the company's structure and mission, including whether OpenAI should be integrated into Musk-owned Tesla. Following his departure, Musk later founded xAI, positioning it as a direct competitor to OpenAI.

Over recent years, Musk has filed several lawsuits against OpenAI, many of which were subsequently dropped or dismissed. The current suit specifically names Altman, Brockman, Microsoft, and OpenAI itself as defendants and has progressed to a jury trial in a California federal courtroom. The proceedings are anticipated to feature testimonies from prominent AI industry leaders, including Microsoft CEO Satya Nadella, Microsoft CTO Kevin Scott, and former OpenAI CTO Mira Murati (now founder of Thinking Machines Lab).

The core of the lawsuit alleges that OpenAI has violated its foundational mission to develop Artificial General Intelligence (AGI) that benefits all of humanity. Additionally, it includes allegations of potential fraud, unjust enrichment, and a breach of OpenAI's charitable trust. Musk is seeking court intervention "to strip Sam Altman and Greg Brockman of their positions of authority and the personal financial benefits they extracted from OpenAI’s illicit for-profit operations and conversion," alongside unwinding OpenAI's for-profit restructuring, among other demands.
